These Player Terms - EULA & Terms of Service ("Terms") are a legal agreement between you and GameName, LLC ("GameName," "Company," "we," "us," or "our").
These Terms apply to your access to and use of our games, demos, betas, public playtests, closed playtests, online services, websites, Discord servers, community spaces, support channels, events, and related services we operate or make available together with our games (together, the "Services").
By downloading, installing, accessing, playing, testing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

If there is a conflict between these Terms and a more specific written agreement we provide for a particular test, event, or program, the more specific agreement controls for that specific program.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the applicable game or software for your personal entertainment use.
The game is licensed, not sold. We and our licensors retain all rights, title, and interest in the Services, including all game code, art, audio, characters, worlds, designs, names, logos, trademarks, systems, documentation, and other content.
You may not copy, sell, rent, lease, sublicense, distribute, publicly perform, commercially exploit, or create unauthorized derivative works from the Services except as allowed by these Terms, applicable platform rules, or written permission from us.
Our games may include online multiplayer, co-op, or other online features. Online features may require internet access, platform accounts, third-party services, matchmaking, servers, voice/chat systems, safety tools, analytics, crash reporting, or other live-service features.
We may patch, update, rebalance, modify, limit, suspend, or discontinue parts of the Services that we operate or control, including playtests, game features, online features, balance, matchmaking, events, or availability.
We do not guarantee that the Services will always be available, uninterrupted, error-free, or compatible with every device, region, platform, or network condition.
We may offer closed tests, public tests, betas, demos, previews, experimental builds, or other unreleased versions of our games.
You understand that these versions may be unfinished, unstable, unbalanced, incomplete, buggy, or subject to change. We may collect feedback, gameplay information, crash information, bug reports, survey responses, and related playtest information as described in our Privacy Policy.
Public playtests may be shared publicly unless we clearly say otherwise.
Closed or private playtests may require a separate Confidential Playtest Agreement or NDA. If a closed test is confidential, you may not stream, post, record, screenshot, share, discuss, leak, datamine, or distribute confidential playtest materials except as we expressly allow in writing.
We welcome bug reports, suggestions, comments, gameplay feedback, survey responses, Discord posts, Steam posts, and other feedback about our Services ("Feedback").
By submitting Feedback to us, you give GameName a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, copy, modify, publish, distribute, display, create derivative works from, and otherwise exploit that Feedback for any purpose, including improving, marketing, developing, and commercializing our games and services.
You understand that we may use Feedback without paying you, crediting you, or asking further permission. Do not submit Feedback if you do not want us to use it.
We are not asking for and do not accept unsolicited game pitches, publishing proposals, story concepts, scripts, characters, levels, lore, business plans, or other creative materials outside our official feedback channels. If you send those materials anyway, we may ignore them, delete them, or treat them as Feedback under this section unless we separately agree in writing.
You may be able to post, upload, transmit, or share content through our Services or community spaces, including messages, usernames, comments, bug reports, screenshots, videos, clips, fan art, reviews, and other content ("User Content").
You keep ownership of your User Content, but you give us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, copy, display, repost, modify, publish, distribute, and promote your User Content in connection with operating, improving, supporting, moderating, and marketing the Services.
You are responsible for your User Content. You may not submit User Content that is illegal, infringing, deceptive, abusive, harassing, hateful, sexually exploitative, threatening, harmful, defamatory, invasive of privacy, or otherwise violates these Terms or our Community Rules.
We may remove, hide, moderate, or restrict User Content at our discretion.
If you believe content in our Services or community spaces infringes your copyright or other rights, contact us at [email protected] with enough information for us to review the issue.
This section is intended as a simple contact route. If GameName later hosts substantial user-generated content, runs a creator marketplace, or publishes third-party games, GameName should add a more formal DMCA/Copyright Policy.

We may warn, mute, kick, suspend, ban, remove access, delete content, reset progress, restrict features, or take other action if we believe you violated these Terms, our Community Rules, platform rules, or the spirit of fair play and community safety.
To ask us to review a moderation decision, contact [email protected]. We may not reverse a moderation decision, but we will consider reasonable appeal requests where appropriate.

We are not trying to prohibit good-faith, non-commercial modding, personal tinkering, accessibility tools, or community-created content that does not harm the game, other players, online services, security, or GameName's rights. We may provide more specific modding guidelines in the future.
Unless we say otherwise for a specific confidential test, you may create and share gameplay videos, livestreams, screenshots, commentary, reviews, and other creator content using publicly available versions of our games.
You may monetize that creator content through normal platform monetization, such as ads, subscriptions, sponsorships, or donations, as long as your use is lawful and does not imply that GameName sponsors or endorses you.
This permission does not allow you to sell our game assets separately, upload raw game files, mislead people, violate confidentiality obligations, or use our trademarks in a way that suggests official partnership without our written permission.
Purchases made through Steam or another platform are handled by that platform and are subject to that platform's payment, refund, wallet, tax, and account rules.
We may offer paid games, downloadable content, cosmetics, virtual items, subscriptions, or other paid features in the future. Unless otherwise required by law or platform rules, digital purchases may be final once delivered or used.
Nothing in these Terms limits any mandatory refund, cancellation, withdrawal, warranty, or consumer protection rights you may have under applicable law.
We may patch, update, rebalance, modify, limit, suspend, or discontinue content, features, online services, events, playtests, or game systems that we operate or control.
We may update these Terms from time to time. If we make material changes, we may provide notice through the Services, our website, Steam, Discord, email, or other reasonable methods. Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
The Services may use or link to third-party services, platforms, tools, or websites, such as Steam, Discord, Codecks, Google, Unity, cloud hosting providers, analytics providers, support tools, crash reporting tools, or other service providers.
We are not responsible for third-party services that we do not control. Your use of those services may be subject to their own terms and privacy policies.
Our Privacy Policy explains how we collect, use, share, and protect information. By using the Services, you acknowledge our Privacy Policy.
These Terms remain in effect until terminated by you or us.
You may stop using the Services at any time.
We may suspend or terminate your access to the Services if we believe you violated these Terms, our Community Rules, platform rules, law, or any applicable playtest or confidentiality agreement.
Sections that by their nature should survive termination will survive, including ownership, feedback, user content licenses, restrictions, disclaimers, limitation of liability, indemnity, governing law, and dispute terms.
To the fullest extent allowed by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or uninterrupted operation.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
To the fullest extent allowed by law, GameName, LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from or related to the Services.
To the fullest extent allowed by law, our total liability for any claim related to the Services will not exceed the greater of: (a) the amount you paid directly to us for the applicable Service in the six months before the claim arose, or (b) $100 USD.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or any other liability that applicable law does not allow us to limit.
Some jurisdictions do not allow certain limits on liability, so some of these limits may not apply to you.
To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless GameName, LLC and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, costs, and expenses arising from your misuse of the Services, your User Content, your violation of these Terms, your violation of law, or your infringement of another person's rights.
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict of law rules.
To the fullest extent allowed by law, any dispute arising from or related to these Terms or the Services will be brought in the state or federal courts located in North Carolina, and you consent to the jurisdiction of those courts.
This section does not limit any mandatory consumer protection rights, dispute rights, venue rights, or governing-law rights you may have under the laws of your country or state of residence.
If any part of these Terms is found unenforceable, the remaining parts will remain in effect.
Our failure to enforce any part of these Terms does not waive our right to enforce it later.
You may not assign these Terms without our written permission. We may assign these Terms as part of a merger, acquisition, sale of assets, corporate reorganization, or similar transaction.
These Terms, together with the Privacy Policy, Community Rules, and any applicable supplemental terms, are the entire agreement between you and us regarding the Services.
